The team of Special Prosecutor Jack Smith filed requests to withdraw federal charges against Donald Trump.
These charges involved attempts to stay in power and retain classified documents. The prosecution cited a legal opinion from the Department of Justice stating that a sitting president cannot be prosecuted.
As the investigators explained, although they still believe in Trump's guilt, the prohibition is "categorical." It does not depend on the seriousness of the alleged crimes nor the strength of the evidence.
- Today's decision by the Department of Justice ends the unconstitutional federal cases against President Trump and is a major victory for the rule of law - commented Trump's team spokesperson, Steven Cheung.
Court cases involving Trump
The charges brought against Trump concerned two cases. In Washington, he was accused of seeking to remain in power despite lacking evidence of electoral fraud. He was charged with violating the Espionage Act by retaining national defense documents in Florida.
Despite the withdrawal of federal charges, Trump is still accused in two state cases.
In New York, he was found guilty of crimes related to concealing hush money payments to Stormy Daniels, and in Georgia, he was charged with attempting to alter the election results.
